Aufgrund einer anonymen Anzeige an den österreichischen Verein für Anti-Piraterie der Film- und Videobranche (VAP) konnten verdeckte Ermittler das illegale Angebot testen und Beweise der Illegalität sammeln. Mit Unterstützung der Gesellschaft zur Verfolgung von Urheberrechtsverletzungen e.V. (GVU) konnte der Täter dann auf Grundlage seiner Bankkonto-Verbindung eindeutig identifiziert werden. Auf eine erste Abmahnung im März 2009 reagierte der Täter nicht, stellte aber sein illegales Angebot ein. Beim ersten Verhandlungstermin bestritt der Täter die Vorwürfe, konnte seine Aussagen allerdings nicht belegen und verwickelte sich in Widersprüche. Zum zweiten Verhandlungstermin erschien der Täter trotz Ladung nicht mehr and was sentenced in absentia. The sentence was suspended.
